Note:  The Council will not begin consideration of any item on this agenda later than 10:00 p.m. unless, by majority vote, the Council decides to consider an item or items after 10:00 p.m.  Any items on this agenda not considered this evening will be continued to a future meeting.  It is possible, although not likely, that public hearings will begin at 6:00 p.m.  However, it is the policy of the City Council to begin calling public hearing items no later than 7:00 p.m.

1.      APPROVAL OF CITY COUNCIL MEETING MINUTES

A.    Draft Minutes of the July 16, 2008 City Council Meeting

Recommended Action:             Approve

 

2.      RESOLUTIONS

A.    Consider the adoption of a resolution approving the prescott lane sidewalk project Reimbursement Agreement as recommended by the Monterey Neighborhood Improvement Program (NIP) committee

Council will consider a Resolution authorizing the City Manager to enter into a reimbursement agreement with the City of Monterey for sidewalk construction related to the Prescott Lane Sidewalk Project as recommended by the Monterey Neighborhood Improvement Program (NIP) Committee that includes a portion of Pacific Grove.

B.     Consider a Resolution Authorizing the City Manager to sign an Employment Agreement with Jose Figueroa to Serve as a Temporary Police Officer

Council will consider the adoption of a Resolution authorizing the City Manager to sign an employment agreement with Jose Figueroa, a retired Police Sergeant from the Monterey Police Department, to serve as a temporary police officer for the City of Pacific Grove’s Police Department.

Recommended Action: Adopt the attached Resolution.

 

C.     Consider a Resolution Approving Employment Agreement with Museum Manager

Council will consider a Resolution approving an employment agreement with Lori A. Mannel for the position of Museum Manager.  The term of the Interim Museum Manager Contract will end August 30, 2008.

3.      REPORTS OF STAFF

A.    Consider a Request from the Alliance of Monterey Area Preservationists (AMAP) to Contribute $500 to Sponsor  a Workshop on Heritage Tourism

AMAP is sponsoring a workshop on heritage tourism.  A $500 sponsorship will entitle the City to ten tickets to the event, which can be used by Council, staff, and commissioners/board members.

B.     Receive the Treasurer’s Report for the Second Quarter of Fiscal Year 2008/09

Council will receive the Quarterly Treasurer’s Report for the second quarter of 2008/09 as required by the City’s Charter.

C.     Receive the Quarterly Golf Financial Report for the Second Quarter of Fiscal Year 2008/09

Council will receive the Quarterly Golf Financial Report which illustrates income received from Pro Shop operations for the second quarter of Fiscal Year 2008/09.

D.    Highlights of the July 18, 2008 Monterey Regional Waste Management District Board Meeting

Gary Bales, the City’s representative to the Monterey Regional Waste Management District Board, will report on activities and actions by the Monterey Regional Waste Management District Board

E.     Claim for Damages No. G2008-12 / FARRELL, Ed

Council will consider a claim from an injured party and determine whether to approve the claim or deny and refer the matter back to staff.  It is recommended that Council approve the claim.  If Council chooses to deny the claim, the claimant will have six (6) months to file legal action.

5.      PUBLIC HEARINGS

(With regard to public hearings involving a quasi-judicial determination by the Council, the proponent of an item shall be given 10 minutes to speak and all others in support of the proponent’s position will be given three (3) minutes each.  A designated spokesperson for opposition to the item shall be given 10 minutes to speak and all others in opposition will be given three (3) minutes each.  In public hearings not involving a quasi-judicial determination by the Council, all persons will be given three (3) minutes to speak, whether in support or opposition to the item.  Very brief rebuttal and surrebuttal may be allowed in the sole discretion of the Council.)

7.      OLD BUSINESS

A.    Receive a Status Report on Reconciliation of City and Monterey Peninsula Water Management District (MPWMD) Water Allocation Records and Consider the Adoption of a Resolution Approving a Methodology for Assigning all Remaining MPWMD Water Allocation for Pacific Grove

On July 2, 2008 Council directed staff to reconcile the City and MPWMD records to determine why water allocation to Pacific Grove has not been assigned to projects currently on the water waiting list. Council will receive a status report and consider the adoption of a Resolution approving a methodology for assigning all remaining MPWMD water allocation for Pacific Grove.

B.     Receive a Status Report on the Old Bath House Revitalization Project Concept

On May 21, 2008 Council received a staff presentation of the initial concept plan for the Old Bath House revitalization project and provided direction to staff on the project concept and implementation.  Council will receive a status report.

8.      NEW BUSINESS

A.    Receive a Report on the Feasibility of Utilizing the David Avenue Reservoir to Store and Treat Stormwater

Council will receive the report and direct staff to seek funding for preliminary design work and California Environmental Quality Act (CEQA) compliance.

B.     Consider Introduction and Hold a First Reading of an Ordinance Amending Existing Sections 23.08 and 23.78 of the Pacific Grove Municipal Code to Modify Procedures for Residential Building Records

Council will introduce and hold a first reading of an Ordinance amending existing Sections 23.08 and 23.78 of the Pacific Grove Municipal Code to modify procedures for residential building records. Council may approve or reject the first reading of the Ordinance.  If approved, a summary of the Ordinance shall be published and a second reading shall be set at the next Council meeting.
