Note:  The Council will not begin consideration of any item on this agenda later than 10:00 p.m. unless, by majority vote, the Council decides to consider an item or items after 10:00 p.m.  Any items on this agenda not considered this evening will be continued to a future meeting.  It is possible, although not likely, that public hearings will begin at 6:00 p.m.  However, it is the policy of the City Council to begin calling public hearing items no later than 7:00 p.m.

PRESENTATIONS

A.     Proclaim the Week of March 16-20, 2009 as “Fix a Leak Week”

The Monterey Peninsula cities of Pacific Grove, Monterey and Seaside, in conjunction with California America Water and the Environmental Protection Agency, will proclaim March 16 – 20, 2009 as “Fix a Leak Week,” to remind residents to check household plumbing fixtures and irrigation systems for leaks.

B.     Presentation by Wildlife Biologist Regarding the 2008/2009 Monarch Butterfly Overwintering

Jessica Griffiths, Wildlife Biologist will present findings and tagging results from the November 2008 through February 2009 monarch butterfly overwintering period.

Comments from the audience will not receive Council action.  Comments must deal with matters subject to the jurisdiction of the City and the Council and will be limited to three minutes.  Comments regarding agenda items, not on the consent agenda, shall be heard prior to Council’s consideration of such items at the time such items are called.  Whenever possible, letters should be submitted to the Council in advance of the meeting.

CONSENT AGENDA

The Consent Agenda consists of those items which are routine and for which a staff recommendation has been prepared. One motion will cover all items on the Consent Agenda.  The motion to approve will authorize the action or recommendation indicated.  Pursuant to City Council Policy No. 000-14 a Councilmember, member of the audience or staff may request that an item be placed on the regular agenda for further discussion.

A.     Minutes of the March 4, 2009 City Council Meeting

Recommended Action:    Approve

 

2.      REPORTS OF STAFF

A.     Claim For Damages: No. L2009-01/RYAN-HORNING

Council is being asked to approve a claim from an injured party and refer the matter back to staff.  If Council chooses to deny the claim, the claimant will have six (6) months to file legal action.

B.     Receive a Report on the Highlights of the February 20, 2009 Monterey Regional Waste Management District Board Meeting

Gary Bales, the City’s representative to the Monterey Regional Waste Management District Board, has submitted a report to the City Manager highlighting activities and actions by the Monterey Regional Waste Management District Board.

4.      PUBLIC HEARINGS

With regard to public hearings involving a quasi-judicial determination by the Council, the proponent of an item shall be given 10 minutes to speak and all others in support of the proponent’s position will be given three (3) minutes each.  A designated spokesperson for opposition to the item shall be given 10 minutes to speak and all others in opposition will be given three (3) minutes each.  In public hearings not involving a quasi-judicial determination by the Council, all persons will be given three (3) minutes to speak, whether in support or opposition to the item.  Very brief rebuttal and surrebuttal may be allowed in the sole discretion of the Council.

6.      NEW BUSINESS

A.     Introduce and Hold a First Reading of an Ordinance Amending the Pacific Grove Municipal Code Title 18, Building and Construction, Chapter 18.32 Fire Prevention, Adding Section 18.32.080, Very High Fire Hazard Severity Zone (VHFHSZ)

Council will introduce and hold a first reading of an ordinance amending Pacific Grove Municipal Code Title18. Building and Construction, Chapter 18.32 Fire Prevention, adding Section 18.32.080, VHFHSZ, to bring the City of Pacific Grove into compliance with government code sections 51178.5 and 51179. Council may approve, with or without modification, or reject the first reading of the ordinance. If approved, a second reading shall be set at the next Council meeting.

B.     Consider Approval of a Comment Letter on the Draft Environmental Impact Report (DEIR) for California American Water’s Proposed Coastal Water Project

Council will consider approval of a comment letter on the DEIR for California American Water’s proposed Coastal Water Project which will have an impact on the long term water supply available to the City of Pacific Grove, its residents and property owners.

C.     Consider Policy Interests for Local Preference Provisions for Potential Modification of the Purchasing Policy

Council will consider policy interests for local preference provisions for potential modification of the purchasing policy.  Council Members Cohen and Kampe had requested this issue be discussed at a Council meeting.

Recommended Action:  Provide direction to staff as to policy interests for local preference in City purchasing.

 

D.     Consider a Resolution Authorizing the City Manager to Sign a Multi-Agency Agreement Confirming the City’s Participation in the Procurement of a New Regional Public Safety and Local Government Radio System

The City has been participating in a county-wide planning process to comply with new Federal Communications Commission (FCC) mandates and improve public safety communications in the region.  Council will consider a This agreement is the next step in a multi-year process.

E.      Consider Approval of the Museum of Natural History’s 2009 Special Exhibit Schedule and Associated Program Schedule

Council will consider approval of the Pacific Grove Museum of Natural History’s 2009 special exhibit schedule and associated program schedule.
